1. Agreement to terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pixel Galaxies s.r.o., a Czech limited liability company (IČO: 19429614), located at Albertova 826/20, Pražské Předměstí, 500 02 Hradec Králové, Czech Republic ("we", "us", "our", or "Pixelrepo").

By accessing or using Pixelrepo ("Service"), you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of service

Pixelrepo is a web-based platform that allows users to:

• Upload and process images into pixel art
• Generate pixel art using AI technology
• Create and edit pixel art manually
• Organize artwork into collections
• Share creations with the community
• Purchase premium pixel art collections

3. User accounts

3.1 Account creation

To use certain features of the Service, you must register for an account. You must:

• Be at least 16 years of age
• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.2 Account restrictions

You may not use another person's account without permission, create accounts through unauthorized means, or maintain more than one personal account.

4. User content

4.1 Your content

You retain ownership of any original content you create and submit to the Service ("User Content"). This includes:

• Images you upload for processing
• Pixel art you create using our editor
• Collections you curate

By publishing User Content publicly, you grant us and other users a worldwide, non-exclusive, royalty-free license to view, download, and use such content. Private content remains visible only to you.

4.2 Content restrictions

You agree not to submit User Content that:

• Infringes any intellectual property or other proprietary rights
• Contains any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
• Promotes sexually explicit or pornographic material
• Promotes violence or discrimination
• Promotes illegal activities or substances
• Contains malware, viruses, or other harmful code

4.3 AI-generated content

Content generated using our AI tools is subject to the specific license terms provided with each collection or generation. You must comply with these license terms when using AI-generated content.

4.4 Content removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

5. Intellectual property

5.1 Service content

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Pixel Galaxies s.r.o. and its licensors.

5.2 Licenses

Content available on Pixelrepo is subject to different licenses:

• Free collections: Include specific license terms with each collection
• Paid collections: Include commercial license terms upon purchase
• User-generated content: Subject to creator's specified terms

You must review and comply with the applicable license before using any content.

5.3 Feedback

Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary and we will be free to use such feedback without any obligation to you.

6. Prohibited uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit any unauthorized advertising or promotional materials
• Impersonate or attempt to impersonate another user or person
• Engage in any conduct that restricts or inhibits anyone's use of the Service
• Use any robot, spider, or other automatic device to access the Service
• Introduce any viruses, trojan horses, worms, or other material which is malicious
• Attempt to gain unauthorized access to any portion of the Service
• Harass, abuse, or harm another person
• Use the Service for any illegal or unauthorized purpose

7. Payments and refunds

Payments for premium content are processed by Stripe. By making a purchase, you agree to Stripe's terms of service.

All sales are final. Due to the digital nature of our products, we do not offer refunds once content has been purchased and delivered.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Disclaimers

9.1 "As is" basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No guarantee

We do not guarantee that the Service will be available at all times or without interruption. We are not responsible for any errors or omissions in the Service.

9.3 Third-party services

We are not responsible for the availability or accuracy of third-party services, including AI generation services, payment processors, or storage providers.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIXEL GALAXIES S.R.O., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Pixel Galaxies s.r.o. and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and associated data
• You remain liable for any outstanding payments
• Provisions that should survive termination will remain in effect

13. Changes to terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.

14. Governing law

These Terms shall be governed and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts located in Hradec Králové, Czech Republic, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
